Since the middle of the 1980s, the law of restitution has assumed a significant role in the law relating to banking and its related activities. In a series of highly significant judgments, the law, both in the UK and in other jurisdictions, has developed rapidly, enthusiastically embracing the law of restitution. Central to this process has been the recognised role of restitution in cases of unauthorised payments, tracing of funds transferred electronically, and misdirected money. Leading contributors address issues of pressing contemporary interest arising with growing frequency in current domestic and international banking practice.
