El acceso a la vivienda se ha convertido en una problemática social de primer orden, debido a la demanda creciente en el mercado inmobiliario, lo que ha generado un aumento significativo de los precios. Uno de los factores que ha influido en esta tendencia alcista en numerosas zonas con gran atractivo turístico, ha sido la demanda de viviendas por parte de ciudadanos extranjeros no residentes, con un poder adquisitivo superior al de la población local. En este contexto, se realiza un análisis jurídico sobre la viabilidad del establecimiento de medidas que restrinjan la adquisición de viviendas por parte de ciudadanos de la Unión Europea que no residan de manera permanente en la región, cuando vayan a ser destinadas a segundas residencias, en el marco del respeto de las libertades fundamentales del mercadoúnico europeo. Se analiza el caso particular de Canarias y su mercado inmobiliario, así como las especificidades que se derivan del reconocimiento de su singular estatus como Región Ultraperiférica de la UE.Access to housing has become a major social problem, due to the growing demand in the real estate market, which has resulted in a substantial increase in prices. One of the factors that has influenced this upward trend in many areas with high tourist appeal has been the demand for housing by non-resident foreign citizens with a higher purchasing power than the local residents. In this context, a legal analysis is carried out on the feasibility of establishing measures to restrict the acquisition of properties by EU citizens not permanently settled in the region, when the dwellings are to be used as second homes, within the framework of compliance with the fundamental freedoms of the European single market. The particular situation of the Canary Islands and its property market is analysed, as well as the specific aspects arising from the recognition of its special status as Outermost Region of the EU.
